RESOLVED: That the minutes of the Development Control Committee held on 4 February 2014 be confirmed as a correct record and signed by the Chair.

The Director of Partnerships, Planning and Policy has submitted eight reports for planning applications to be determined (enclosed).

The Director of Partnerships, Planning and Policy submitted eight applications for planning permission.

In considering the applications, Members of the Development Control Committee took into account the agenda reports, the addendum and the verbal representations and submissions provided by officers and individuals.

Planning permission approved subject to conditions

Speakers: Applicant – Robert Maycock (Go Ape).

RESOLVED (unanimously) - That planning permission be approved subject to the conditions as detailed in the agenda.

Advertising consent granted subject to conditions

RESOLVED (unanimously) – That advertising consent be granted subject to the conditions as detailed in the agenda.

Planning permission approved subject to conditions.

Speakers: Objector – Sophie Marshall (PWC Surveyors – representing residents), Applicants Agent – Tony Lang (RT Design Consultants).

RESOLVED (12:0:1) – That planning permission be approved subject to the conditions as detailed within the report in the agenda, and the amendment of condition 1 in the agenda to read: The lights hereby approved shall be used for security purposes only and shall not be used as a source of illumination for the riding arena to enable the training/riding horses within the riding arena during the hours of darkness nor for the harrowing of the arena.

Tree works consent granted subject to conditions. 

Speakers: Objector – Alan Whittaker, Ward Councillor – Paul Leadbetter.

It was proposed to refuse the planning application on the grounds of the unnecessary removal of healthy trees.  At the vote the motion was lost (3:10:0).

RESOLVED (9:3:1) – That tree works consent be granted subject to the conditions as detailed within the report in the agenda, with delegated authority in consultation with the Chair and Vice-Chair of this Committee, to amend condition four to address timing of works, any necessary mitigation measures to protect wildlife or nesting birds and to address failed specimen replacement trees.

RESOLVED (12:0:1) – That planning permission be approved subject to the conditions detailed within the report in the agenda, and the amended condition detailed in the addendum.

Planning permission approved subject to a section 106 legal agreement and conditions

RESOLVED (unanimously) – That planning permission be approved subject to a section 106 legal agreement and the conditions as detailed within the report in the agenda and the condition as detailed in the addendum.

Reserved matters approved subject to conditions

RESOLVED (unanimously) – That reserved matters be approved subject to conditions, with delegated authority to officers to draft the conditions regarding the grassed area and hard landscaping; such conditions to be agreed with the Chair and Vice Chair of this Committee.

RESOLVED (unanimously) – That reserved matters be approved subject to the conditions as detailed within the report in the addendum.

RESOLVED (unanimously) – That the Tree Preservation Order No.7 (Heapey) 2013 be formally confirmed without modification.

The Chair reminded Members of the Development Control Committee about the Neighbourhood Planning workshop on Tuesday 11 March 2014 at 4pm.

RESOLVED (unanimously) – That a notice under Section 215 of the Town and Country Planning Act 1990 be served on those persons with an interest in the land in order to remedy the harm caused to the amenity of the area.
