Declarations of Any Interests

Members are reminded of their responsibility to declare any personal interest in respect of matters contained in this agenda. If the interest arises only as result of your membership of another public body or one to which you have been appointed by the Council then you only need to declare it if you intend to speak.

 

If the personal interest is a prejudicial interest, you must withdraw from the meeting. Normally you should leave the room before the business starts to be discussed. You do, however, have the same right to speak as a member of the public and may remain in the room to enable you to exercise that right and then leave immediately. In either case you must not seek to improperly influence a decision on the matter.

There was no declaration of interest by any of the three Sub-Committee Members in the meeting’s agenda item.

 

(In the light of the above minute, Councillor Ralph Snape left the meeting at this stage at approximately 10.20am).

The Corporate Director of Governance submitted a report on an application under the Licensing Act 2003 for a premises licence in respect of Cyprus Gardens, 85 Bolton Street, Chorley to allow the sale of late night refreshments from the property.  The application sought permission to sell refreshments until 12.30am on Mondays to Thursdays and until 2.00am on Fridays and Saturdays.

 

Five representations from interested parties had been received, citing objections to the application in relation to two of the four Licensing Objectives (ie the prevention of crime and disorder; and the prevention of public nuisance).

 

The applicant (accompanied by a supporter) and three of the interested parties were present at the meeting.

 

On hearing representations from the applicant that he was not proceeding with his purchase of 85 Bolton Street and that he wished to withdraw his application, the Chair adjourned the hearing in order for the Sub-Committee to obtain legal advice.

 

On being asked to show evidence of his intention to withdraw the application, the applicant signed a letter confirming his intent, and the interested parties also confirmed that they had no further representations to make on the matter.

 

The Chair accordingly announced to the meeting that the application in respect of Cyprus Garden, 85 Bolton Street, Chorley had been formally withdrawn and closed the meeting.
