Declarations of Any Interests

Members of the Sub-Committee are reminded of their responsibility to declare any personal interest in respect of matters contained in this agenda in accordance with the provisions of the Local Government Act 2000, the Council’s Constitution and the Members Code of Conduct.  If the personal interest is a prejudicial interest, then the individual Member should not participate in a discussion on the matter and must withdraw from the Council Chamber and not seek to influence a decision on the matter.

The Director of Customer, Democratic and Legal Services submitted a report requesting the Sub-Committee to determine an application for a premises licence in respect of Little Green Men, 18 Windermere Drive, Adlington, Chorley.

 

The report indicated that the application requested licensable activities to be as follows:

 

Supply of alcohol (m) – Off the premises

 

Monday – Sunday            0800 – 1800

 

Hours the premises are open to the public

 

Premises are not open to the public – despatch for deliveries only.

 

The report also outlined the proposed operating schedule indicating that the premises shall be used for the processing and despatch of telephone, internal and mail orders of alcoholic products.

 

The premises do not pose any risk to the licensing objectives therefore no additional measures are considered necessary apart from those shown in the submitted report.

 

No representations had been received from Responsible Authorities and there had been 22 representations from interested parties to the application.  The objections were relevant to the licensing objectives of:

 

?         Prevention of crime and disorder

?       Public Safety

?         Prevention of public nuisance

?       The Protection of Children from Harm

 

The representations were indicated in the report.

 

The applicant along with his representative attended the meeting in support of the application and seventeen representations were received on the likely effect on the grant of a premises licence relevant to the four licensing objectives.

 

The Sub-Committee raised a number of pertinent issues with the applicant and the representatives of the interested parties and noted the applicant had offered up at the meeting conditions in his operating schedule to minimise the impact on the licensing objectives.

 

The Sub-Committee also considered all the written and verbal evidence in the interests of the premises of the Council’s adopted Statement of Licensing Policy and Government Guidelines.

 

After taking account of the representations and relevant factors the Sub-Committee arrived at the following unanimous DECISION:

 

The Licensing Sub-Committee have considered carefully the applicants representations and the interested parties representations.

 

We have considered the guidance issued under Section 182 of the Act together with the Council’s Statement of Licensing Policy in particular those paragraphs referred to in the report.

 

The Committee has had regard to the fact that no responsible authorities have made representations to the application.  Whilst the Committee took account of the interested parties representations, there have been no representations from Environmental Health, Lancashire Police and the Planning and Highway authorities.

 

The Committee also took account that the Statement of Licensing Policy indicates that predetermined closing times will be avoided unless necessary to promote the licensing objectives.

 

The Committee have taken into account the residents concerns regarding the location being inserted on the applicants website and although this Committee are restricted from putting such a condition on the license, the Committee would appreciate if the applicant would continue as he is doing at present in omitting such location from his website.
