Declarations of Any Interests

The Member is reminded of his responsibility to declare any personal interest in respect of matters contained in this agenda. If the interest arises only as result of membership of another public body or one to which the Member has been appointed by the Council then he only needs to declare it if he intends to speak.

 

If the personal interest is a prejudicial interest, then the individual Member should not participate in a discussion on the matter and not seek to improperly influence a decision on the matter.

The Executive Member had no reason to declare an interest in the item under consideration at the meeting.

To consider the exclusion of the press and public for the following item of business on the ground that it involves the likely disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A to the Local Government Act 1972.

57-59 Market Street, Chorley - Assignment of Lease of Cafe

To consider the enclosed confidential report of the Property Services Leader  with Liberata.

Minutes:

The Executive Member for Resources considered a report from the Property Services Leader with Liberata on the recommended assignment of the residue of the lease of the ground floor café at 57-59 Market Street, Chorley.

 

A 10 year lease of the ground floor of 57-59 Market Street, was granted in March 2006 to enable the premises to trade as a café.  The current tenant intended to emigrate shortly and had proposed that the remainder of the lease be transferred to a person interested in continuing the café business.  If agreed, the proposed assignee would assume responsibility for the existing lease terms and conditions.

 

The outcome of the Property Services Officer’s investigations into the proposed assignee’s references was outlined in the report, as a result of which the Officer had been satisfied as to the suitability of the assignee.

 

Decision made under delegated authority:

 

That approval be given to the assignment of the remainder of the current 10 year lease of the ground floor café at 57-59 Market Street, Chorley to Mrs S M A Booth, subject to satisfactory references being obtained.

 

Reason for decision:

 

The assignment of the lease will enable both the operation of the café business and the Council’s income source to continue.

 

Alternative option(s) considered and rejected:

 

No other assignee has been proposed, so, consequently, no alternative had been considered.
