Declarations of Any Interests

Members are reminded of their responsibility to declare any pecuniary interest in respect of matters contained in this agenda.

 

If you have a pecuniary interest you must withdraw from the meeting. Normally you should leave the room before the business starts to be discussed. You do, however, have the same right to speak as a member of the public and may remain in the room to enable you to exercise that right and then leave immediately. In either case you must not seek to improperly influence a decision on the matter.

Exclusion of the Public and Press

To consider the exclusion of the press and public for the following items of business on the ground that it involves the likely disclosure of exempt information as defined in Paragraph 4 of Part 1 of Schedule 12A to the Local Government Act 1972.

 

By Virtue of Paragraph 1: Information relating to any individual.

Condition:

Information is exempt to the extent that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Information is not exempt if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to Regulation 3 of the Town & Country Planning General Regulations 1992(a).

RESOLVED –That the press and public be excluded from the meeting for the following items of business on the ground that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act 1976 - Application to renew a private hire drivers licence

Minutes:

The Sub Committee considered a report of the Director of Public Protection, Streetscene and Community in the presence of the driver and his representative to consider if he was a fit and proper person to have his licence renewed.

 

Officers had received the driver’s application to renew his private hire driver’s licence on 16 May 2014, together with the DVLA Group II Medical in support of his application, which indicated medical issues that had given cause for the Council’s Medical Advisor, to make representation with regards as to whether the driver was a fit a proper person to continue to hold a Private Hire Driver’s Licence.

 

The Council’s Medical Advisor recommended that the driver provide three blood pressure readings to be taken one week apart, each of which, to be within DVLA limits. On 30 June 2014, the driver provided further results for his blood pressure readings that satisfied the medical advisor; he therefore recommended that the Council issue the driver with a licence for a period of 12 months.

 

The Council’s Medical Advisor noted that the driver had just started medication for his blood pressure and he therefore recommended that the driver’s blood pressure readings be provided again in a years’ time to ensure  he is still compliant with the treatment and lifestyle advice given by his GP and that his blood pressure is still acceptable.

 

The Sub Committee was satisfied that the driver was safe to drive with this additional monitoring in place and RESOLVED to:

 

a)    Revoke the driver’s licence PHD0750 with immediate effect.

b)   Re-issue the driver with a PHD licence for a period of 12 months(accepting that all the current PHD conditions of a licence had been met) and attaching the following conditions: The driver is to provide three consecutive satisfactory blood pressure readings, to be taken prior to the renewal date of that licence, such readings shall satisfy DVLA Group II Medical Standards, the driver to provide a written declaration to state that he has continued to follow the guidance given by his GP in relation to treating his blood pressure.

c)  To delegate authority to Officers to re-issue the driver’s PHD licence upon satisfactory receipt of the information requested in paragraph b, above for the following 2 years, (this will extend the driver’s entitlement to a three year period in line with the fee paid to date and in line with current licensing provisions.

d)   Should the driver not be in a position to satisfy the above conditions at the end of 12 and 24 month intervals, to authorise Officers to suspend the driver’s PHD licence and refer the matter back to the General Licensing Sub Committee to determine whether he is a fit and proper person to continue to hold a PHD licence.
