Planning applications to be determined The Director (Customer and Digital) has submitted two items for planning applications to be determined (enclosed).

In considering the applications, Members of the Development Control Committee took into account the agenda reports, the addendum and the verbal representations and submissions provided by officers and individuals. |

19/00417/FULMAJ - Land Adjoining Cuerden Residential Park, Nell Lane, Cuerden PDF 221 KB Additional documents: Decision: Full planning permission granted, subject to conditions and a Section 106 legal agreement. Minutes:
Registered speakers: Sarah Elsy (Objector), Cllr Mark Clifford (Parish Councillor) and Cllr Peter Gabbott (Ward Councillor).
After careful consideration it was proposed by Councillor Chris France, seconded by Councillor Martin Boardman and a decision was subsequently taken (11:0:2) that full planning permission be granted, subject to conditions in the report and addendum, and a S106 legal agreement to secure the provision of affordable housing and a financial contribution towards the provision of public open space.
It was agreed that the following additional conditions be attached:
1. No construction access shall be allowed from Nell Lane in the interests of pedestrian and highway safety, and to minimise the impact on biodiversity. If no agreement can be reached with the applicant, then the application shall be returned to committee. 2. There shall be no access to the site from Nell Lane other than in the case of an emergency. 3. A maximum of up to 5 metres of hedgerow only shall be removed along Nell Lane to form the emergency access.
The wording of these conditions to be agreed by the Director of Customer and Digital in consultation with the Chair and Vice Chair.

Minutes: After careful consideration, it was proposed by Councillor Chris France, seconded by Councillor Martin Boardman and a decision was subsequently taken (unanimously) - That a S215 notice be issued in respect of the following amenity issues;
a) The land is causing unacceptably adverse effects on the visual amenity of the area by virtue of the overgrown nature of the vegetation in the front and rear garden.

The Planning Services Manager noted an inaccuracy in the report and advised that Planning Application: 19/00047/AGR – Inspectorate Reference: APP/D2320/W/19/3222949 had been allowed.
One appeal had been lodged, two appeals had been dismissed and one appeal had been allowed. |

Minutes: After careful consideration it was proposed by Councillor Alistair Morwood, seconded by Councillor Martin Boardman and a decision was subsequently taken (unanimously) - That the Committee support the recommendation to Full Council, the proposal to change the name of the Committee to Planning Committee.
